Terms of Service
1. What this service is
After Action Reports ("the Service") is an AI-assisted drafting tool for law enforcement officers. You provide rough notes; the Service generates a structured report draft from those notes.
The Service does not file reports, submit reports to any records system, make legal determinations, or provide legal advice. It is a drafting aid, comparable to dictation software. Every word filed under your name is your responsibility.
2. Beta notice
The Service is currently in beta. It is experimental and may produce inaccurate, incomplete, or unusable output. Do not rely on the Service for any purpose without independent verification. Features, pricing, and these terms will change as the Service develops.
3. Eligibility and accounts
- You must be at least 18 years old.
- The Service is intended for sworn law enforcement officers and other personnel authorized by their agency to prepare reports. By creating an account, you represent that you are authorized to use the Service in this capacity.
- Accounts are for your individual use only and are not transferable.
- You are responsible for keeping your login credentials confidential.
4. Your responsibilities
This is the core of the agreement. By using the Service, you agree that:
(a) You review everything. You will read, verify, and correct every draft before using it for any official purpose. A draft is not a report until you say it is.
(b) The filed report is yours. Any report you file, submit, or certify based on a Service draft is solely your work product. The Service is not a co-author.
(c) You follow your agency's rules. You are responsible for complying with your department's policies, including any policy restricting or prohibiting AI assistance, and with all applicable laws and regulations. If your agency does not permit this type of tool, do not use it.
(d) You do not rely on the output. AI-generated text can contain errors and fabrications. You agree not to rely on any draft without independent verification of every material fact.
(e) Your records are your job. Maintaining official records is your responsibility, in your department's records management system. The Service is not a records system, and the automatic deletion described in Section 6 is an intended privacy feature you agree to, not a records-retention service.
5. Data you provide
(a) Your warranty. You represent and warrant that you have all necessary rights and authorizations to input any data you provide to the Service, and that doing so does not violate any law, regulation, court order, department policy, or confidentiality obligation.
(b) Prohibited categories. Do not input:
- Sealed or expunged records;
- Confidential informant identities;
- Information relating to active undercover operations;
- Juvenile identities where the law protects them from disclosure;
- Any other data you are specifically prohibited from sharing.
(c) You own your drafts. You retain all rights to the notes you input and the reports you produce. We claim no ownership over your content.
6. How we handle your data
We believe you should know exactly what happens to your information:
(a) Demo (no account). Demo drafts are never stored on our systems.
(b) Account drafts. Drafts are automatically and permanently deleted 24 hours after you last work on them. We are a drafting tool, not a records system; your department's records management system is the system of record.
(c) We do not sell your data, and we do not use your data to train AI models.
(d) Processing. Draft generation is performed with the assistance of a third-party AI infrastructure provider (currently DeepInfra). Your notes are transmitted to that provider for the sole purpose of generating your draft. We are not responsible for the acts or omissions of our subprocessors.
(e) Security posture, stated plainly. We use encryption in transit and at rest, and we delete drafts as described above. We are not CJIS-compliant and the Service is not a CJIS-compliant system. If your use case requires CJIS compliance, do not use the Service for that data.
(f) No duty to preserve. We have no duty to preserve your drafts or any other data for litigation, discovery, or any other purpose. The automatic deletion described above is a deliberate privacy feature of the Service, which you expressly agree to as a condition of use.
7. Acceptable use
You agree not to: misuse the Service; attempt to disrupt, reverse-engineer, or gain unauthorized access to it; use it for any unlawful purpose; or input data described in Section 5(b).
We may suspend or terminate accounts that violate these terms.
8. Intellectual property
The Service, including its software, design, and branding, is owned by After Action Reports and protected by applicable intellectual property laws. Your use of the Service does not grant you any ownership interest in it.
If you provide feedback or suggestions about the Service, you agree we may use them without obligation to you.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT DRAFTS WILL BE ERROR-FREE OR SUITABLE FOR FILING.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFTER ACTION REPORTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION ANY CONSEQUENCES FLOWING FROM A REPORT YOU FILE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 IF YOU PAID NOTHING. THIS REMEDY IS EXCLUSIVE, AND YOU AGREE THIS CAP REFLECTS A FAIR ALLOCATION OF RISK FOR THE SERVICE AS OFFERED.
11. Indemnification
You agree to indemnify and hold harmless After Action Reports, its officers, and its agents from any claims, damages, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these terms, or your violation of any law, regulation, or department policy.
12. Dispute resolution
These terms are governed by the laws of the State of Wisconsin. Any dispute shall be resolved by binding arbitration on an individual basis, and you waive any right to participate in a class action or to a jury trial. Any claim must be brought within one (1) year after the events giving rise to it, regardless of any longer period allowed by law. The prevailing party in any dispute shall be entitled to recover reasonable attorney's fees and costs. Venue for any proceedings shall be Dane County, Wisconsin.
13. Term and termination
These terms apply for as long as you use the Service. Either party may terminate at any time. On termination, your drafts remain subject to the 24-hour deletion described in Section 6(b).
14. Changes to these terms
We may update these terms as the Service grows. Material changes will be communicated to account holders, and continued use after changes take effect constitutes acceptance.
15. General
If any provision is found unenforceable, the remaining provisions continue in full effect. These terms constitute the entire agreement regarding the Service. Contact: afteractionreportllc@gmail.com.
16. No third-party beneficiaries; no agency
These terms are solely between you and After Action Reports. No department, defendant, victim, or other third party has any rights under these terms. Nothing in these terms or your use of the Service creates an agency, partnership, joint venture, employment, or fiduciary relationship.
